Cancellation Of Work Permit In China

Have you ever had a problem with the renewal of your work permit in China? If you are an expatriate living and working in China chances are you have. It is one of the most common problems related to expats and their employers. Because expatriates have an employment contract for a specified period, the work permit will expire at the end of this contract period. When it does expire without being renewed, this can lead to some legal issues for expatriates.

What happens if my employer cancels my work permit? If your employer attempts to cancel your work permit, you will be removed from the temporary residence permit (Z visa) system. Because you no longer have a valid visa, you would be considered an illegal overstay which means you could be detained and deported by the Chinese government.

There is a huge scam going around in China. The main problem is that this scam has been running for months, sometimes years, because everyone knows the other but no one files a report. So employers are not aware of this scam and usually fall for it. I questioned some friends and most of them did not know about this issue until I brought it up to them.

3-Step Registration

Required Materials

1. One original (electronic/paper) copy of the Cancellation Application Form of the Foreigner’s Work Permit.

After logging in to http://fwp.safea.gov.cn/ and having filled out the online form, the applicant (the employer) must print it out, sign it, stamp the employer’s official seal or the official seal of the department authorized by the employer on it, and upload it to the website.

2. One original (electronic/paper) copy of the certification of the terminated employment relationship, terminated contract or other certifying materials demonstrating the reasons for cancellation

The termination certificate had to have been signed by both parties prior to submission. In the case that the applicant left their position on their own and their employer were unable to contact them, the employer is then required to submit a letter of cancellation which must explain the details and circumstances .

3. One original (electronic/card) copy of the Foreigner’s Work Permit, along with the  valid Foreign Expert Certificate and Alien Employment Certificate (if applicable).

All original documents and Mandarin translations of these must be uploaded (in original color) to the service system for foreigners working in China http://fwp.safea.gov.cn/. 

Please note: All non-Mandarin certification materials submitted must be accompanied by Mandarin translations and stamped with the official seal of the employer (except the passport or international travel documents). The authorizing or decision-making institution may request the employer to submit a corrected version if there is a serious discrepancy between the Mandarin translation and the original.

Bring All the Original (not photocopies) Documents to the Corresponding Windows

After a successful online verification, the employer is required to make an appointment on the system and then bring his appointment voucher and all original application materials (as explained in points 1 and 2 above) to the proper venue for handling. The one exception to this rule is that the High-Level Foreign Talents (Class A) do not need to make an appointment and can bring all materials directly on-site for handling.
